1. Purpose

Ugly Sweater Store is operated by Big4rest LLC. We respect the intellectual property rights of others and expect the same of everyone who uses this website. This page explains how copyright owners can notify us of claimed infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and how a counter-notification can be submitted.

We sell only original designs created for our store. If we receive a valid notice showing that a listing infringes someone else's rights, we will remove or disable access to that listing.

2. How to submit a DMCA notice

If you believe that material on this website infringes a copyright that you own or are authorized to enforce, send a written notice that includes all of the following (17 U.S.C. § 512(c)(3)):

1. A physical or electronic signature of the copyright owner or of a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to be infringed, or, if several works are covered by one notice, a representative list of those works.
3. Identification of the material claimed to be infringing that is to be removed or disabled, with information reasonably sufficient for us to locate it, including the exact URL of each product page or image on this website.
4. Your contact information: full name, postal address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices that do not substantially include these elements may not be processed. For trademark or other intellectual property concerns, please send the same details to the address below and describe the right claimed.

3. Where to send notices

4. What happens after we receive a notice

We review notices promptly. When a notice substantially meets the requirements above, we will act expeditiously to remove or disable access to the identified material, and we will make reasonable efforts to notify the person who provided the material. We may contact you if we need more information to locate the material or to complete our review.

5. Counter-notification

If material you provided was removed or disabled and you believe this happened because of a mistake or misidentification, you may send a written counter-notification to the designated agent above. It must include (17 U.S.C. § 512(g)(3)):

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location (URL) where it appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.

After receiving a valid counter-notification, we will forward a copy to the person who submitted the original notice. Unless that person informs us that they have filed a court action seeking to restrain the activity, the removed material may be restored no sooner than 10 and no later than 14 business days after we receive the counter-notification, as provided in 17 U.S.C. § 512(g)(2)(C).

6. Repeat infringer policy

We remove listings found to infringe and keep records of notices received. Where appropriate and in our discretion, we will terminate the accounts or access of users or contributors who are repeat infringers.

7. Misrepresentation warning

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. If you are not sure whether material infringes your copyright, please consider seeking legal advice before sending a notice.
