These Terms of Service govern access to and use of https://uglysweater.store and purchases from Ugly Sweater Store.

Ugly Sweater Store is operated by Big4rest LLC, a limited liability company registered in New Mexico, United States.

By visiting the website, creating an account, or placing an order, the customer agrees to these Terms of Service and the policies linked on the website.

1. Online Store

Ugly Sweater Store is an online print-on-demand retailer.

Every product is made after an order is placed. The store does not hold finished product inventory and does not operate a walk-in retail location.

2. Eligibility

A customer must be old enough to enter into a legally binding purchase contract in the customer’s jurisdiction.

A person using the website on behalf of a business confirms that the person has authority to bind that business.

3. Product Information

Ugly Sweater Store makes reasonable efforts to provide accurate product titles, descriptions, materials, measurements, colors, images, prices, and availability.

Screen settings, lighting, production methods, and manual measurement may create minor differences between a product image and the received product.

Product measurements may have the tolerance stated on the product page.

Customers must review product details, personalization, and the Size Guide before ordering.

4. Print-on-Demand Production

All products are made through print-on-demand production after an order is placed.

Production normally takes 3 to 5 business days. Peak-season production may require additional time.

Production begins after the 4-hour cancellation and modification window closes.

5. Orders

An order is an offer to purchase products under these Terms.

Ugly Sweater Store may accept, reject, or cancel an order because of:

  • Incorrect pricing or product information

  • Payment failure

  • Suspected fraud

  • An unavailable production method or material

  • An undeliverable address

  • A legal or policy restriction

  • A product that cannot lawfully be produced or delivered

If Ugly Sweater Store cancels a paid order, the payment returns to the original payment method.

6. Order Cancellation and Modification

Customers may request a cancellation, address correction, or other modification within 4 hours of purchase.

Requests must be sent to support@uglysweater.store with the order number.

An order cannot be cancelled or changed after production begins.

7. Prices and Payment

Prices are shown in United States dollars (USD), unless Shopify presents a localized currency for an eligible market.

Payment methods available for an order are displayed at Shopify checkout and may include major credit or debit cards, PayPal, Apple Pay, Google Pay, and Shop Pay depending on the customer's device, location, and checkout eligibility.

Checkout shows the product subtotal, discounts, shipping charges, and applicable taxes before payment.

Customers outside the United States may be responsible for customs duties, import taxes, or other charges imposed by the destination country.

8. Shipping and Delivery

Shipping rates, supported destinations, tracking information, and estimated delivery times appear in the Shipping and Delivery Policy:

Delivery estimates are not guarantees. Carrier delays, customs inspections, local delivery conditions, severe weather, and other events outside reasonable control may affect delivery.

9. Returns, Replacements, and Refunds

Every product is made for an individual order.

Ugly Sweater Store does not accept returns, refunds, or exchanges because the customer changed their mind, selected the wrong size, or submitted incorrect personalization.

A damaged, defective, misprinted, incorrectly measured, or incorrect product may qualify for a replacement or refund under the Return, Replacement, and Refund Policy:

This restriction does not limit any consumer right that cannot be excluded under applicable law.

10. Customer Content and Personalization

A customer who uploads or submits an image, name, text, design, photograph, trademark, logo, or other content confirms that the customer has the right to use that content for the requested product.

The customer must not submit content that:

  • Infringes intellectual property or privacy rights

  • Is unlawful, fraudulent, defamatory, threatening, or abusive

  • Contains malware or harmful code

  • Violates the rights of another person or organization

Ugly Sweater Store may reject or cancel an order containing prohibited content.

11. Intellectual Property

The website design, original written content, brand name, logo, and original product artwork owned by Big4rest LLC are protected by applicable intellectual property laws.

Third-party names, trademarks, characters, logos, or other protected material remain the property of their respective owners.

A product listing must not imply sponsorship, endorsement, authorization, or affiliation with a third-party rights holder unless such authorization exists.

A rights holder can submit an intellectual property notice through the DMCA and Intellectual Property Notice page or by emailing support@uglysweater.store.

12. Reviews and User Content

A customer who submits a review, photo, comment, or other public content grants Big4rest LLC a nonexclusive license to use that content for operating and promoting Ugly Sweater Store, subject to applicable law and the Privacy Policy.

Reviews must reflect a genuine experience and must not contain unlawful, misleading, abusive, or infringing content.

Ugly Sweater Store may remove content that violates these Terms.

13. Prohibited Uses

A person must not use the website to:

  • Break applicable law

  • Commit fraud

  • Interfere with website security

  • Introduce malicious software

  • Collect personal information without authorization

  • Submit false orders or claims

  • Misrepresent identity

  • Infringe intellectual property rights

  • Abuse payment, refund, replacement, or promotional systems

14. Third-Party Services

The website uses services provided by Shopify, Stripe, production partners, shipping carriers, and other providers.

Third-party services may have separate terms and privacy policies. Big4rest LLC is not responsible for a third party’s independent website or service, except where applicable law provides otherwise.

15. Disclaimer of Warranties

The website and services are provided on an as-available basis to the extent permitted by law.

Nothing in these Terms excludes a product warranty, consumer guarantee, or other right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, Big4rest LLC is not liable for indirect, incidental, special, or consequential loss arising from use of the website or products.

This limitation does not apply where liability cannot be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by law, a user agrees to indemnify Big4rest LLC against claims arising from:

  • A violation of these Terms

  • Unlawful use of the website

  • Content submitted without the required rights

  • Infringement caused by customer-submitted personalization

18. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles.

Mandatory consumer protections and jurisdiction rights in the customer’s location remain unaffected.

19. Severability

If a provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

20. Changes to These Terms

Big4rest LLC may update these Terms to reflect changes in operations, services, technology, or legal requirements.

The revised Terms appear on this page with an updated date.
